America Online and LearnKey, Inc. warrant to you that the Software will perform substantially in accordance with the Documentation for the thirty (30) day period following your receipt of the Software. To make a warranty claim, you must return the Software to the location where you obtained it along with proof of purchase within such thirty (30) day period. If the Software does not perform substantially in accordance with the Documentation, the entire liability of America Online or LearnKey, Inc. and your exclusive remedy shall be limited to either, at America Online's option, the replacement of the Software or the refund of the purchase price you paid for the Software. The foregoing states the sole and exclusive remedies for America Online's, LearnKey, Inc.'s, or their suppliers' breach of warranty. The limited warranty set forth in this section gives you specific legal rights. You may have other rights, which vary from state to state or jurisdiction to jurisdiction.

No Other Warranties
Except for the limited warranty set forth above, the authors, developer, America Online, and LearnKey, Inc. make no other warranty of any kind, either expressed, implied, or statutory as to any other matters, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title or non-infringement of third party rights. No oral or written information of advice or support given by America Online or LearnKey, Inc., its agents or employees or failure to provide same shall create a warranty or in any way increase the scope of any warranty contained herein. Some states or jurisdictions do not allow the exclusion of implied warranties or limitation on how long an implied warranty may last, so the above limitations may not apply to you. To the extent permissible, any implied warranties are limited to ninety (90) days.
Limitation of Liability
Neither the author, developers, America Online, its agents or employees, nor LearnKey, Inc. shall be liable for any special, indirect, consequential, or incidental damages whatsoever (including damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this product, even if the authors, developers, America Online, its agents or employees, LearnKey, Inc., or any supplier have been advised of the possibility of such damages, or for any claim by any third party. Some states or jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.
By using this product, users acknowledge that they have read this limited warranty, understand it, and agree to be bound by all of its terms and conditions. Users of this service also agree that this limited warranty is the complete and exclusive statement of agreement between the parties and is superior to any other agreements, oral or written, and any other communications between the parties relating to the subject matter of the limited warranty.
